Welcome to RoofingContractors.org, operated by the American Roofing Contractors Organization (ARCO) ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, digital tools, and related services (collectively, the "Site"). By accessing or using this Site, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Site.
1. Acceptance of Terms
By accessing or using RoofingContractors.org, you confirm that you are at least 18 years of age and legally capable of entering into binding agreements. Your continued use of the Site constitutes acceptance of these Terms and our Privacy Policy.
2. Scope of Services
RoofingContractors.org provides:
- A directory and accreditation platform for roofing contractors;
- Educational resources and consumer guides for homeowners; and
- Referral and matching services that connect homeowners with accredited contractors ("Match Reports").
We do not perform roofing services or guarantee the performance of any listed contractor. The Site is provided for informational purposes only.
3. Contractor Accreditation and Listings
ARCO-accredited contractors undergo a verification process that may include license checks, insurance verification, and reference review. While we strive for accuracy, we cannot guarantee that all information provided by contractors or third parties is complete or error-free.
ARCO accreditation does not imply endorsement, warranty, or guarantee of workmanship or safety. Users must perform their own due diligence before hiring any contractor.
4. No Professional Advice Disclaimer
All content on RoofingContractors.org—including articles, checklists, and accreditation materials—is provided for general informational purposes only. It does not constitute professional, legal, financial, or construction advice. You should consult qualified professionals before making any decisions based on information obtained from this Site.
5. Payment Terms and Refund Policy
Certain services—such as contractor accreditation applications, membership renewals, or homeowner Match Reports— may require payment.
- Payment Authorization: By submitting payment information, you authorize ARCO or its third-party processors to charge your selected payment method.
- Refunds: Application, accreditation, and membership fees are generally non-refundable, except where required by law or explicitly stated in writing. Refund requests must be submitted in writing within 7 days of payment.
- Chargebacks: Unauthorized chargebacks will result in suspension of services and potential collection action.
- Pricing Changes: We reserve the right to adjust pricing for services at any time, with notice posted on the Site.
6. User-Generated Content and Reviews
If the Site allows users or contractors to submit content—such as reviews, testimonials, or comments—you agree that:
- You are solely responsible for the content you submit.
- You grant ARCO a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, and display your submitted content.
- You will not post false, defamatory, obscene, infringing, or otherwise unlawful material.
- ARCO reserves the right (but not the obligation) to remove or edit content at its discretion.
ARCO assumes no liability for user-submitted content and does not endorse or verify the accuracy of reviews or statements posted by users.
7. Intellectual Property
All trademarks, logos, trade names, content, software, and other materials on RoofingContractors.org are the property of ARCO or its licensors. You may not reproduce, modify, distribute, or otherwise exploit this content except for personal, non-commercial use.
8. Third-Party Links and Content
The Site may include links to third-party websites or embedded services. We are not responsible for the content, privacy practices, or actions of third parties and disclaim all liability arising from their use.
9. Limitation of Liability
To the fullest extent permitted by law, ARCO, its affiliates, and their officers, directors, employees, and agents shall not be liable for any:
- Direct, indirect, incidental, consequential, special, or punitive damages;
- Loss of profits, data, or goodwill;
arising out of or related to your use of (or inability to use) the Site or any contractor engagement. Your sole remedy for dissatisfaction with the Site is to stop using it.
10. Indemnification
You agree to indemnify and hold harmless ARCO, its affiliates, and representatives from any claims, damages, losses, or expenses (including attorneys' fees) resulting from your use of the Site, your submitted content, or your violation of these Terms.
11. No Warranty
All information and services are provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
12. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or harms other users or our reputation.
13. Arbitration and Class Action Waiver
Binding Arbitration:
You agree that any dispute, claim, or controversy arising from or relating to these Terms or your use of RoofingContractors.org shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Class Action Waiver:
You and ARCO agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class action or collective action. You waive any right to participate in a class, collective, or representative proceeding.
Arbitration Location and Fees:
The arbitration shall take place in Delaware, and each party shall bear its own costs, subject to the arbitrator's authority to reallocate fees under applicable law. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
Opt-Out Option:
You may opt out of this arbitration clause by notifying ARCO in writing within 30 days of first using the Site. Opt-out notices must be mailed to: American Roofing Contractors Organization, 1763 Columbia Rd NW Ste 175 PMB 405751, Washington, DC 20009.
14. Governing Law
These Terms are governed by and construed under the laws of the State of Delaware, without regard to conflict-of-law principles. Any court proceedings to enforce an arbitration award or related matter shall be brought exclusively in the state or federal courts located in Delaware.
15. Modifications to the Terms
We reserve the right to modify these Terms at any time. Any changes will be effective upon posting to this page. Continued use of the Site after updates constitutes acceptance of the new Terms.
16. Accessibility
We are committed to digital accessibility for all users. Please review our Accessibility Statement for details.
17. Privacy
Your use of the Site is also governed by our Privacy Policy.
18. SMS / Text Message Program
This Section 18 governs your participation in the text messaging program ("Program") operated by the American Roofing Contractors Organization (ARCO) ("we," "our," or "us") at RoofingContractors.org. It is part of these Terms of Use. Messages are sent via the Twilio messaging platform.
By providing your mobile number and opting in, you agree to this Section 18 and our Privacy Policy. If you do not agree, do not opt in to the Program.
Program description
The Program consists of two separate message categories. Each has its own consent, and you may participate in one without the other:
- Award Delivery Messages (transactional). Messages about the shipment and delivery of your award package, including shipping notifications, tracking updates, delivery confirmations, and requests to confirm delivery details. These require a separate, optional opt-in.
- Accreditation Messages (recurring automated marketing). Recurring automated marketing and informational messages about ARCO Accreditation, including accreditation status, benefits, profile updates, activation reminders, renewal reminders, member communications, and program news. These require a separate, optional opt-in.
The Program is intended for roofing contractors and individuals who have provided their mobile number to ARCO through our website, forms, award verification flow, or other authorized channels.
How to opt in
Consent is collected separately for each category described above. Checking one box does not opt you in to the other, and we will not send you Accreditation Messages unless you have separately opted in to receive them.
You may opt in by:
- Checking the box for Award Delivery Messages during award verification;
- Checking the optional box for Accreditation Messages during award verification;
- Replying START, YES, or UNSTOP to a message from us after previously opting out;
- Any other method we may offer, where your affirmative consent is captured for the specific category of messages.
Your opt-in consent is specific to your mobile number and the device you provide. By opting in, you certify that you are the subscriber of, or an authorized user of, the mobile number provided and are at least 18 years old.
We keep a record of each consent you give, including the mobile number, the date and time, and the exact consent language shown to you at the time.
Message frequency
Message frequency varies based on your interaction with ARCO and the services you use. You may receive messages when events occur, for example award package shipping events, or on a recurring basis for program communications. We do not guarantee a fixed number of messages per month.
Message & data rates
Message and data rates may apply. Charges for SMS/MMS messages are billed by and payable to your wireless carrier under your mobile plan. ARCO does not charge you for the messages we send, but your carrier may. Contact your wireless provider for details of your plan.
Sample messages
Examples of messages you may receive:
Award Delivery Messages:
- "ARCO: Your award package has shipped and is expected to arrive in 5-7 business days. Tracking: [link]. Reply STOP to cancel, HELP for help."
- "ARCO: Reminder: your delivery confirmation is pending. Please confirm at [link]. Reply STOP to cancel, HELP for help."
Accreditation Messages:
- "ARCO: Your accreditation renewal is due in 30 days. Visit [link] to renew. Reply STOP to cancel, HELP for help."
- "ARCO: Your ARCO profile is ready to review. View it at [link]. Reply STOP to cancel, HELP for help."
How to opt out (STOP)
You may cancel the Program at any time. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message you receive from us. After you send the opt-out message, we will send you a one-time confirmation text acknowledging that you have been unsubscribed. After that confirmation, you will not receive additional messages unless you opt in again.
Opting out applies to the messages sent from the number you replied to, and may stop both categories of messages described above. If you want to stop only Accreditation Messages while continuing to receive Award Delivery Messages—or the reverse—email [email protected] and we will update your preferences.
You may continue to receive messages for a short period while your opt-out is processed by your carrier. If you have questions or problems unsubscribing, email [email protected].
Help (HELP)
For help at any time, reply HELP to any message you receive from us. You will receive a reply with customer support contact information. You may also contact us directly at [email protected] or (202) 235-0078.
Consent is not required as a condition of purchase
Your consent to receive text messages is not required as a condition of purchasing any goods or services from ARCO, and you may opt out at any time without affecting your ability to use our services. Consent to receive Award Delivery Messages and consent to receive Accreditation Messages are each entirely optional: declining either does not affect delivery of your award, your accreditation status, or your ability to use the Site.
Supported carriers
The Program is available on major U.S. carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, Alltel, and their affiliates. Carriers are not liable for delayed or undelivered messages.
Delivery of messages is subject to the effective transmission from your wireless service provider/network operator and is outside of our control. T-Mobile is not liable for delayed or undelivered messages.
Privacy & data sharing
Information you provide when you opt in to the Program, including your mobile number, opt-in timestamp, and consent record, is handled in accordance with our Privacy Policy.
We do not sell, rent, or share your mobile number or SMS opt-in data with third parties or affiliates for their marketing or promotional purposes. Mobile information, including opt-in consent and the text messages themselves, is shared only with our messaging infrastructure provider (Twilio) and other service providers strictly as necessary to deliver messages on our behalf.
Changing your mobile number
You agree to notify ARCO of any changes to your mobile number and to update your account so that we can direct messages to the correct device. Email [email protected] to update your number. You agree to indemnify ARCO for any privacy or communications-related claims arising from your failure to notify us of a change to your number.
Compatible devices
The Program requires a compatible wireless device capable of receiving SMS and/or MMS messages. We are not responsible for messages that cannot be delivered because your device is not compatible, out of coverage, powered off, or otherwise unable to receive messages.
Disclaimer of warranties (Program)
The Program is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, ARCO disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Program will be uninterrupted, timely, secure, or error-free.
Limitation of liability (Program)
To the fullest extent permitted by applicable law, ARCO, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your participation in the Program, including but not limited to damages for delayed, undelivered, or misdirected messages, or for any cost or charges imposed by your carrier.
Compliance with law
The Program is operated in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the CTIA Messaging Principles and Best Practices, and applicable carrier requirements. We maintain records of your consent and opt-in method in accordance with these requirements.
Updates to this Section 18
We may update this Section 18 from time to time. Changes take effect when posted to this page, with the "Last Updated" date at the top revised accordingly. Material changes may be communicated by text message, email, or on-site notice. Your continued participation in the Program after changes are posted constitutes your acceptance of the revised terms.
